OVERVIEW
Welcome to verse & vision! The terms “we”, “us” and “our” refer to verse & vision. verse & vision operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). verse & vision is powered by Wix Stores ecommerce platform, which enables us to provide the Services to you.
These terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”) describe your rights and responsibilities when you use the Services.
Please read these Terms carefully, as they include important information about your legal rights and cover areas such as cancellation rights, warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not use or access our Services.
SECTION 1 – ACCESS AND ACCOUNT
By agreeing to these Terms, you represent that you are at least 16 years old, and you have given us your consent to allow any of your minor dependants to use the Services on devices you own, purchase or manage.
To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide information such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current and complete and that you have all rights necessary to provide it.
You are solely responsible for maintaining the security of your account credentials and for all activity on your account. You may not transfer, sell, assign, or license your account to any other person.
SECTION 2 – OUR PRODUCTS
We make every effort to present our products and services accurately. However, colours and appearance may vary from your screen due to device and display settings.
Nothing in these Terms limits your statutory rights in relation to goods that are not of satisfactory quality, not fit for purpose, or not as described.
All product descriptions are subject to change at any time without notice. We may discontinue any product at any time and may limit quantities offered to any person, region or jurisdiction on a case-by-case basis.
SECTION 3 – ORDERS
When you place an order, you make an offer to purchase. We may accept or decline your order at our discretion. Your order is accepted when we send an Order Acceptance/Dispatch Confirmation email; at that point a contract is formed between you and us. We must receive and process your payment before acceptance.
Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests after acceptance (this does not affect your cancellation rights under Section 6). If we do not accept, make a change to, or cancel an order, we will attempt to notify you using the contact details provided.
Your purchases are subject to our returns & Refund policy. This does not affect your statutory rights.
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
SECTION 4 – PRICES AND BILLING
Prices. All prices shown on our site to UK customers are inclusive of UK VAT (where applicable). All prices shown on our site to EU customers are inclusive of EU VAT (where applicable). Prices shown to customers outside the UK and EU do not include any taxes. Shipping charges are shown at checkout. If you order for delivery outside the UK, you may be responsible for any import duties/taxes charged locally.
Promotions & changes. Prices, discounts and promotions may change without notice. The price charged will be the price in effect at the time you place your order and will be set out in your order confirmation.
Payment information. You agree to provide current, complete and accurate purchase, payment and account information for all purchases, and to promptly update details (e.g., email, card numbers, expiry dates) so we can complete transactions and contact you as needed.
You represent and warrant that (i) the payment method you provide is valid and authorised, (ii) you are duly authorised to use it, (iii) charges will be honoured by your provider, and (iv) you will pay all charges at the posted prices, including shipping and any applicable taxes/duties.
SECTION 5 – SHIPPING AND DELIVERY
Delivery times. We will deliver within the timeframe shown at checkout or, if none is shown, within 30 days of your order.
Risk and title. Risk in the goods passes to you on delivery (or on delivery to a carrier you chose and arranged where that carrier was not offered by us). Title passes when we receive full payment.
Delay. If we cannot deliver on time, you may specify a new reasonable date; if we still do not deliver, you may cancel the order for a full refund.
Carrier delays. Delivery times are estimates and not guaranteed. We are not responsible for delays caused by carriers, customs, or events outside our control, save as set out above.
Nothing in this section affects your legal rights.
SECTION 6 – YOUR RIGHT TO CANCEL (DISTANCE CONTRACTS)
If you purchase as a consumer (not a business), you have a legal right to cancel most online purchases within 14 days after the day you (or someone you nominate) receives the goods, without giving any reason.
To cancel, notify us within that period using the contact details in Section 25.
Returns & refunds. Please send the goods back within 14 days of telling us you’re cancelling. We will refund the price paid and the standard delivery cost (not any enhanced delivery you chose) within 14 days of receiving the goods back, or of you supplying evidence of having sent them back, whichever is earlier. You are responsible for return postage unless the item is faulty or we have agreed otherwise.
Exceptions. Your cancellation right does not apply to personalised or made-to-order items, sealed items not suitable for return for health or hygiene reasons once unsealed, or other exceptions permitted by law.
This section is in addition to your rights where goods are faulty or misdescribed.
SECTION 7 – FAULTY OR MISDESCRIBED GOODS
If goods are faulty, not as described or not fit for purpose, you have legal remedies under the Consumer Rights Act 2015. Please contact us and we will arrange repair, replacement, price reduction or refund as appropriate. These rights apply regardless of our Returns & Refunds Policy.
SECTION 8 – INTELLECTUAL PROPERTY
Our Services, including all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by Verse & Vision, its affiliates or licensors and are protected by UK and international intellectual property laws.
These Terms permit you to use the Services for personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material on the Services without our prior written consent. All rights not expressly granted are reserved.
Verse & Vision names, logos, product and service names, designs, and slogans are trademarks of Verse & Vision or its affiliates or licensors. You must not use such trademarks without prior written permission. “Wix” and related marks are trademarks of Wix. Other names and logos are the trademarks of their respective owners.
SECTION 9 – OPTIONAL TOOLS
You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor control.
You acknowledge that we provide access to such tools “as is” and “as available” without warranties or endorsements and we have no liability arising from your use of them. Use is at your own discretion and subject to the third party’s terms.
We may offer new features from time to time; such features form part of the Services and are subject to these Terms.
SECTION 10 – THIRD-PARTY LINKS
The Services may contain materials and links to third-party websites (including embedded functionality). We are not responsible for examining or evaluating the content or accuracy of third-party materials or sites you choose to access. Access is at your own risk.
We are not liable for any harm or damages related to your access of third-party websites or your purchase/use of any third-party products or services. Review third-party policies carefully before engaging in any transaction. Complaints regarding third-party products/services should be directed to the relevant third party.
SECTION 11 – RELATIONSHIP WITH WIX
Verse & Vision is powered by wix, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Verse & Vision. By using the Services, you acknowledge and agree that Wix is not responsible for any aspect of sales between you and Verse & Vision, including any injury, damage, or loss resulting from purchased products and services. You expressly release Wix and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Verse & Vision.
SECTION 12 – PRIVACY
We are the data controller for your personal data. We process personal data under the UK GDPR and the Data Protection Act 2018. Our Privacy Policy explains what we collect, why, the lawful bases, how long we keep it, who we share it with (including Wix as our e-commerce provider), international transfers, and your rights (including your right to complain to the ICO).
Because the Services are hosted by Wix, Wix also processes personal information about your access to and use of the Services to provide and improve the Services. Information you submit to the Services will be shared with Wix and certain partners which may be located in other countries. See our Privacy Policy (and Wix privacy policy) for details.
SECTION 13 – FEEDBACK
If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, feedback, reviews, proposals, plans, or other content (collectively, “Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display such Feedback in any medium for any purpose, including commercial use.
You represent and warrant that: (i) you own or have rights to the Feedback; (ii) you have disclosed any compensation or incentives received in connection with your submission; and (iii) your Feedback complies with these Terms. We may, but are not obliged to, monitor, edit or remove Feedback we determine to be unlawful, offensive or infringing.
SECTION 14 – ERRORS, INACCURACIES AND OMISSIONS
Occasionally the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times or availability. We reserve the right to correct any errors or omissions and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).
SECTION 15 – PROHIBITED USES
You may use the Services for lawful purposes only. You must not use the Services: (a) for any unlawful or malicious purpose; (b) to violate any applicable laws or regulations; (c) to infringe our intellectual property rights or those of others; (d) to harass, abuse, insult, harm, defame, slander, intimidate or otherwise harm any person; (e) to transmit false or misleading information; (f) to upload material that does not comply with these Terms; (g) to send unsolicited advertising or spam; (h) to impersonate any person or entity; or (i) to engage in conduct that restricts or inhibits anyone’s use or enjoyment of the Services, or which may harm Verse & Vision, Wix or users of the Services, or expose them to liability.
You also agree not to: (a) upload or transmit viruses or malicious code; (b) reproduce, duplicate, copy, sell, resell or exploit any portion of the Services; (c) collect or track others’ personal information; (d) spider, crawl, or scrape; or (e) interfere with or circumvent security features. We may suspend, disable, or terminate your account without notice if you violate these Terms.
SECTION 16 – TERMINATION
We may terminate these Terms or your access to the Services (or any part) at any time at our discretion. You remain liable for all amounts due up to and including the date of termination.
The following sections survive termination: Sections 6–9, 11–12, 17–23, and any provisions that by their nature should survive.
SECTION 17 – DISCLAIMER OF WARRANTIES
We work to ensure descriptions and images are accurate (minor colour variation may occur). Nothing in these Terms limits or excludes your legal rights in relation to goods that are not of satisfactory quality, not fit for purpose or not as described.
Except as expressly stated by us, the Services are provided on an “as available” basis and we do not guarantee that your use will be uninterrupted or error-free.
SECTION 18 – LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be limited or excluded by law (including your statutory rights under the Consumer Rights Act 2015).
Subject to the foregoing, we will not be liable for losses that were not reasonably foreseeable to both parties at the time of contract, and (for non-faulty goods/services) our total liability for any order is limited to the amount you paid for that order.
SECTION 19 – INDEMNIFICATION
You agree to indemnify, defend and hold harmless Verse & Vision, Wix, and our respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from losses, damages, liabilities or claims (including reasonable legal fees) payable to any third party due to or arising out of (1) your breach of these Terms or incorporated documents, (2) your violation of law or third-party rights, or (3) your access to and use of the Services. We will notify you of any indemnifiable claim and may control the defence and settlement (at your expense). You will cooperate reasonably in the defence.
SECTION 20 – SEVERABILITY
If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision shall be enforced to the fullest extent permitted by law and the unenforceable portion shall be deemed severed; the validity of the remaining provisions shall not be affected.
SECTION 21 – WAIVER; ENTIRE AGREEMENT
Our failure to exercise or enforce any right or provision shall not constitute a waiver of such right or provision.
These Terms and any policies or operating rules posted by us on the site or in respect of the Services constitute the entire agreement between you and us and govern your use of the Services, superseding any prior or contemporaneous agreements, communications and proposals (oral or written).
Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.
SECTION 22 – ASSIGNMENT
You may not delegate, transfer or assign these Terms or any rights or obligations under them without our prior written consent; any attempt will be void. We may transfer, assign, or delegate these Terms and our rights and obligations without consent or notice.
SECTION 23 – GOVERNING LAW AND JURISDICTION
These Terms and any contract for the sale of goods or services to you are governed by the law of United Kingdom. We both agree that the United Kingdom courts will have jurisdiction. If you live elsewhere in the UK, you may also bring proceedings in your local courts.
SECTION 24 – CHANGES TO THESE TERMS
You can review the most current version of the Terms at any time on this page. We may update these Terms from time to time by posting changes on our website. We will notify you of any material changes in accordance with applicable law; such changes take effect on the date specified in the notice. Your continued use of the Services after changes are posted constitutes acceptance of those changes.
SECTION 25 – COMPLAINTS AND ADR
We aim to resolve complaints internally—please contact us using the details below. If we cannot resolve a complaint, we will provide details of an approved UK alternative dispute resolution (ADR) provider and tell you whether we are willing to engage with ADR. You are not prevented from going to court.
